Additionally, the government may continue their investigation and surveillance of my clients associates in an effort to gain negative testimony against my client. I would review any potential videotapes to
determine if any Fifth Amendment violations during the arrest process were not done properly. Like I mentioned in my discussion the
Defense Attorney needs to be very proactive and determine if any exculpatory information or evidence is available to discredit the potential government informants. Trials for
high level drug dealers can be very dangerous unless the government has very clear evidence and if any informants are willing to cooperate
with the government. These
cooperative informants are usually persons of interest and are trying to gain some leverage from the government of a reduced sentence for another crime. Finally, informants
are at high risk for retaliation in jail, prison or on the street and are not credible witnesses under cross examination from a skilled defense attorney.
