Security and Privacy Breach
Social media is a critical part of daily life for billions of individuals, including nurses as healthcare professionals in different care settings. Social media allows people to interact, share information, communicate and above all, share happy moments with friends, families, and even colleagues (Geraghty et al., 2021). However, social media use by nurses while on duty and even in their personal lives requires a delicate balance to prevent security and privacy breaches, especially based on the provisions of the Health Insurance Portability and Accountability Act of 2006 (HIPAA) and the requirements for privacy of protected health information.
In 2021, Jackson Health commenced investigation into a social media account of a nurse after she posted images of a baby born in the facility with a birth defect on Facebook. The nurse worked in the facility’s neonatal intensive care unit and posted the images of the baby with gastroschisis as one of the scary moments of her work on that day. She captioned the photos with words to illustrate the disruption and disbelief that the site of the baby’s condition has on her great working day. The implication is that by posting these images on social media without getting approval and consent from the facility and the parents was a serious breach of patient privacy and ethical working. HIPAA provisions classify patient images as protected health information (Alder, 2021). The incident breached legal provisions of the HIPAA law on privacy and protection of protected health information.
Secondly, the nurse also failed ethical requirement of confidentiality and trust with the patient’s parents. Nurses are expected to keep patient’s trust and develop confidential approaches concerning patient health information (Ahmed et al., 2020). It was unethical for the nurse to post the disturbing photos of the baby born with the rare defect. The institution is expected to train its nurses on HIPAA regulations regularly to avoid such costly privacy and security breach that have ethical and legal implications.
