Search and Seizure

Define here: Protects citizens over this specific layer of protection from unreasonable action without probable cause proof of a specific target from a government employee/officer.

Explain here (one sentence): before an officer can seize (taken into custody) a home car objects person etc the officer must have probable cause to inspect further acting insert once the thing is identified as evidence then the officer may take it into custody.

Explain here (one sentence): the intention of an examination of a person home car etc is to discover a violation of criminal law but not having the expectation of finding something of evidentiary value.

Example here (one sentence): (his example, make up a new example) the officer sees a green leafy substance in the car warrants further inspection in order to see if it is something more like marijuana

Warrantless Searches

Define here: involves the search of someone’s person and their immediate surroundings, within an arm’s reach radius to make sure an officer and surrounding citizens safety. Allows an officer to recover evidence to charge the suspect.

Explain here (one sentence): stop and frisk is a brief detention and pat down of the suspects outer clothes, allows the officer time and space to investigate possible illegal actions if the officer is within reason suspicious of the suspect.

Explain here (one sentence): when an officer suspects a suspect having something illegal, or dangerous in his car, home, or person and officer will conduct a search and seizer following any evidence the officer might have.

Example here (one sentence): officer bob pulls over john for a speeding in a school zone, there is a child in the back seat and John is acting very strange nervous and angry. Officer Bob asks how old the child is and he angrly says its none of his business. The officer suspects the man is kidnapping and has a gun. Officer Brad asks the man to step out of the car and does a brief pat down. Officer bob finds a gun and arrests John.

Exigent Circumstances

Define here: any circumstance where an officer or civilians are in a serious and dangerous situation having to act quickly and having to suddenly take immediate action

Explain here (one sentence): when there is an emergency situation and immediate action is needed to protect and/or protect life and evidence

Explain here (one sentence): when there is no time for a search warrant, and/or an officer sees something in plain view, withought a suspect having to move anything, an officer can collect it as evidence

Example here (one sentence): officer bob received a 911 call to a home for domestic disturbance, the officer sees a gun and a white powdery substance on the table in plain view. The officer has immediate jurisdiction to take a closer look to examine it and take as evidence

Probable Cause

Define here: a collection of information from sight, hearing, smell, touch, and taste, and/or from another person providing information a reasonable person that thinks the same as the mass population that sees evidence or has reason to believe a crime/future crime may be committed and an officer need to take authority.

Explain here (one sentence): a mass of citizesns that think and see the big picture is okay/not okay authenticating the actions, not using intimate, personal emotions but all reliable information sufficient awareness before action is taken that is justified and accepted

Example here (one sentence): Officer bob was told by a student a car in the parking lot of the school was smoking , officer bob walks up to the car and immediately sees what appears to be a bong in the back seat, a green leafy substance, a skunk like smell, smoke coming out of the car, foggy windows, and the suspect laughing with red eyes. The officer in good faith is safe to assume, and justify the suspect is smoking marijuana.
