Iliana Rodriguez worked at the University of Miami Hospital when she took a medical leave of absence. Current law states that employees may return to the position they had prior to their leave, unless the employer can make a substantial argument for the change in position being to due to factors other than the leave. When Rodriguez returned to work, the original plan was for her to return to her original position with a plan in place to improve her work. However, when Rodriguez returned to work she was placed at a different position that she did not want, and argued that before she left she was told she would stay at her original position. Her employers argued that even though there was a potential improvement plan, their meeting before she left was a prior indication that she was not performing well at her position and that was the reason for her moving to a new position after her leave.
