Description of HIPAA and HITECH Act
The Health Insurance Portability and Accountability Act ( HIPAA) and the Health Information Technology for Economic and Clinical Health Act are two legislations that have come with a host of changes regarding the use of patient information and data and the use of health information technology to improve patient actions. It is, therefore, important for healthcare professionals to understand these two Acts and how they are related to the use of patient data and information, and the penalties that come with violating these rules. HIPAA is a set of practices formulated to help in governing the privacy of individual health records. Therefore, HIPAA covers various information such as Protected Health Information (PHI), Electronic Protected Health Information (ePHI), and Personally Identifiable Information (PII). While this law started operating in 1996, HITECH Act only came to force over a decade later in 2009 (Sewell, 2019). Part of this Act focuses on providing an economic stimulus package for expanding and promoting the adoption of health information technology, such as Electronic Health Records, by various healthcare providers. Therefore, while HIPAA mainly focuses on protecting patient privacy, HITECH promotes the use of health technology through funding.
The Implication of the Legislation on Nursing Practice and Research
This legislation has implications for nursing practice and nursing research. One of the implications is that every activity undertaken by nurses when providing care should focus on protecting patient private information, PHI, and PII. As such, the information should not be shared with any unauthorized individual. HITECH Act also directs that nurses use health technology such as EHR to enhance patient care processes and procedures (Sewell, 2019). In addition, those involved in nursing research should strive to protect the PHI and PII by using various strategies such as coding to help hide patient identity.
