CRITERIA:
You are an attorney at Dewey, Cheatham, and Howe Law Firm. The firm has been approached by Kelsey Swanson about taking the case, and suing St. Jude’s. You are tasked with telling the Senior partners whether to take the case or not, and why. The memo should be 7-10 pages, typed, double spaced, proofread and spellchecked and grammar-checked, appropriate references to the case file, with clearly marked subheadings for each section.
Section I- Issues (1 page) Your paper should include the following—-
1) A verbatim statement of the relevant law (Liability, Negligence, etc.)
2) An explanation of how you believe the law will likely be interpreted. Base your assessment of the interpretation on the summaries of court rulings and evidence/testimony laid out in your packet.
3) A list of questions raised by the law
Section II: Relevant Facts (1-2 pages): A very brief overview of the incident in question to orient the reader to the case and to highlight the facts that will be relevant in interpreting the issues raised by the law.
Section III: Analysis (5-7 pages) An objective assessment of how each side of the case will be able to answer the questions raised by the law, which will lead to a conclusion about whether or not the firm should take the case. Go, literally, issue by issue through the law. This section should be primarily a critical evaluation of the evidence available in the case. Your evaluation should be based on the material presented in class about evidence evaluation and the evaluation of the overall case theory. You must draw conclusions about the quality of the evidence/testimony in this section. Do not merely describe it. Cite from the case packet to back up your statements. This is the heart of the memorandum.
Section IV: Conclusion (at least a paragraph or two…): This section is your recommendation for how the case should proceed. Should you take the case? Do you believe that St. Jude’s will settle out of court when presented with the suit, or will they vigorously defend themselves based on the evidence? How is a jury likely to respond to the case? What is your recommendation to the Senior Law Partners?
